As a side note, it looks like SunTV has run a piece on the Fourniers in connection with another of the many, many defamation cases proceding against Free Dominion.  In addition,  since April a good dozen Blogging Tories have made an appearance, for one reason or another.  If the station lasts three months they'll have interviewed their entire prime-time audience.

Your Daily Nazi: Why The CRTC Shouldn't Let Nazis Set The Standard For Truth In Broadcasting

There is a world of difference between [Neo-Nazi Ernst] Zundel and regulated broadcasters. Zundel was a private citizen( well not actually a citizen) where as a regulated broadcaster is licensed by the state to disseminate information, as such it is reasonable to expect that as a condition of that license that you would be subject to a certain level of standards higher than that applied to a private citizen that does not carry the De facto seal of approval from said state.

I don't know if this passes muster as legal reasoning--remember the CRTC is apparently worried that their truth in broadcasting reg might be unconstitutional--but it makes sense to me.

Warman Vs. White

Ottawa human rights lawyer Richard Warman is down in Roanoke, VA, testifying in the trial of Neo-Nazi leader William A. White. There's even a nifty blog devoted to the trial. One of the interesting things about this case is that Ezra Levant, lost in the furious foaminess of his own mind, once questioned the very existence of Mr. White, suggesting that he might be a CHRC plant. This inspired a nasty reply from the man (White) himself:

... I assure you, I am not merely an ethereal apparition of the God of the Light and Order, opposed eternally to your race of demons, but I have material form as well.

Dunno whether Ezra's updated his theories on White's material form etc. He seems pretty bummed out these days from the collapse of the Speechy Jihad.

Whereas I appreciate the point that the commenter wishes to make, namely that speech calling for violence is abusive; this article abrogates the basic ethics of journalism by quoting a defendant's assertion given at a human rights hearingthat has never been settled.

Here is the phrase: "...the defence suggested Warman--a former CHRC employee--was among those who would post provocative messages to the site using fake identities, in the hope of entrapping other site users..."

Even though described as the "defendant's suggestion at hearing" this kind of quote causes the[...] newspaper to side in an as yet unsettled legal dispute. I certainly hope that the newspaper doesn't interfere with or make pronouncements on other legal proceedings in the same way.

I think Harry might have got the newspaper in question wrong, which is why the quick edit above. But otherwise he catches what is at the minimum some exceedingly shoddy reporting out of...you guessed it...CanWest.

Just for clarity, here's an expanded version of the quote he mentions:

Your Daily Nazi: Ezra's Statement Of Defense Regurgitates Nazi Sources

The full text of Ezra' statement is here.

Just a couple of points. The picture above left is related to paragraph 41 of Ezra's statement, which reads in part:

In 2006, Mr. Warman paid for a bus to transport dozens of ARA [Anti Racist Action] Members to the Toronto home of Mr. [Paul] Fromm.

ARA was and is a decentralized group of anti-Fascist activists working in Canada and the U.S. If you lived in Toronto, esp. during the 1990s and earlier part of this decade, you might have read about how this "ragamuffin band of homeless street kids and anarchists" out-hustled and out organized our local white supremacist contingent, including at the event depicted above left.

While Richard Warman addressed the group in 2005, the only evidence ever presented to the effect that he rented a bus to get them to Paul Fromm's Toronto residence is the photo shown above left. A couple of days ago, a member of ARA's Toronto chapter contacted me with information on the 2006 incident(1):

This is a canard that has been spread by neo-nazis...too obtuse to understand a sarcastic placard when they see one ("Thanks Richard Warman for the bus rental" - meant to taunt the fascists) ...In fact, the bus, which cost approximately $200, was paid for by ARA organizers.

Put another way, Ezra's lawyers are unable to distinguish between a joke placard and a financial statement.

In fact, part of the problem with Ezra's statement of defense is how heavily it leans upon material gleaned from this site. While the people behind Richardwarmen.com are still mysterious, immediately upon its creation word of the page was published on Stormfront (warning, link to Neo-Nazi website!). This is something you don't want to happen if you intend to use material from a site in your libel defense. It rather lowers the credibility of that material.

Furthermore, at several points in his statement of the defense Levant refers to "the ARA" which, given the fact that "ARA" stands for "Anti Racist Action", is ungrammatical. Correct is "ARA" or "the ARA network". What is telling is that this particular error is typical of Neo-Nazi references to the group. For example, here and here (Warning! More Nazis!). Another sign of where the material in Ezra's statement originates.

(1) This account has been corroborated from a number of other sources. The point of the placard is that previously members of the Stormfront community had speculated that Warman must be renting buses for the ARA network, so many of them were turning out for Anti-Ernst Zundel protests.

FreeD Hires Zundel's Lawyer

...to defend them in their lawsuit against Richard Warman.Barbara Kulaszka is a Canadian lawyer best known for her role in defending far-right figures, like Ernst Zundel, and Paul Fromm, and Marc Lemire, and Imre Finta.

She is also the author (or editor, depending on the attribution) of "Did Six Million Really Die? Report of the Evidence in the Canadian 'False News' Trial of Ernst Zündel".

Mark Steyn sings her praises here.

Oddly enough, it didn't have to be like this. Back in December, Connie and Mark announced that they had hired a well-respected Ottawa lawyer named Kenneth Bickley but it appears that he is no longer involved in the case.

What Is At Stake?

Behind all the recent battling over free speech vs. human rights lies Kieth Martin's private member's motion M-446:

M-446 — January 30, 2008 — Mr. Martin (Esquimalt—Juan de Fuca) — That, in the opinion of the House, subsection 13(1) of the Canadian Human Rights Act should be deleted from the Act.

Should this ever come to a vote then section 13(1) is deleted from the act, and the Nazis run free, right?

Incorrect! M-446 is not a private member's bill; it's a private member's motion. The HOC explains how these work as follows:

Private Members’ motions are used to introduce a wide range of issues and are framed either as orders or resolutions, depending on their intent. [58] Motions attempting to make a declaration of opinion or purpose, without ordering or requiring a particular course of action, are considered resolutions. [59] Hence, such motions which simply suggest that the government initiate a certain measure are generally phrased as follows: “That, in the opinion of this House, the government should consider …”. The government is not bound to adopt a specific policy or course of action as a result of the adoption of such a resolution since the House is only stating an opinion or making a declaration of purpose. [60]

Or, as Ezra himself puts it:

...as a motion (as opposed to a bill), it is what lawyers might call obiter dicta -- a non-binding statement of opinion, not a change in the law. Martin's motion is a call for a Parliamentary rebuke of the Canadian Human Rights Commission.

What M-446 will amount to should it pass, and this is all it will amount to should it pass, is a verbal spanking for the CHRC at the hands of Parliament.

Which puts the motion's abysmal level of support in a whole new light: a mere four MPs have indicated they will vote in favor of M-446 and, arguably, one of these is on the list because he was conned by a Nazi. Not only will Parliament not repeal Section 13(1), they are afraid to even say anything nasty about it.

The Nazis Strike Back

I believe Human Rights commissions are the wrong mechanism for dealing with hate speech. Most of their Islamicist litigants place no real value on civil rights, except to use their grievances as a cudgel. I know they wouldn't speak up for yours or mine, or for natural human rights in the Muslim world. I also find it very disturbing that Ottawa lawyer and former Canadian Human Rights Commission employee Richard Warman is the litigator in the vast majority of the Sec. 13(1) cases. But I just read a posting on an American Nazi web site that not only clearly calls for Warman's murder, it publishes his home address.

That's from Mark Bourrie's Ottawa Watch site. I won't link to material referenced, but yeah its out there, and Mr. Bourrie's post contains enough background that if you want you can find it.

In Canada, The FireBombs Fly From Right To Left

Ezra chooses a most inopportune moment to go all cultural relativist on us:

Two groups of protesters met in Calgary yesterday: 25 members of the "Aryan Guard" white supremacist group, and 150 assorted leftist urchins, led by Bonnie Collins, the Communist Party candidate and spokewoman for the often-violent group, Anti-Racist Action.

A pox on both of their houses, I say.

And that's the point. I despise them both. But I don't think either group should be arrested for having foul ideas. According to the press reports that I've seen, there was some chanting and sign-waving and even a few leaflets being handed out, but no violence, and no incitement of violence.

No incitement of violence but, just possibly, real violence directed against Ms. Collins' family not a month ago:

But since they started posting pictures of themselves on the Internet with guns and baseball bats -- and after two recent Molotov cocktail attacks in the city were tied to possible white supremacist activity -- it's the counter-protesters who have to hide their faces. One person who knows the danger of standing up against the neo-Nazis is Bonnie Collins.

That moment was painfully relived Friday, when Bonnie -- as part of a counter-demonstration -- confronted the neo-Nazis, who asked her, "How's your house, Bonnie?" while standing behind a cordon of police officers on the front steps of city hall.

"Is it nice and toasty in there? How's Jason and the kids?"

Apart from gaining ground in their intimidation campaign, the neo-Nazis showed they have absolute freedom of movement in Calgary.

Of course Ezra must know about all this stuff. It was reported widely in the Calgary MSM and here, among other places. That he chooses to brush off this important feature of the story says more about how hide-bound his own philosophy has become than about the real danger posed by a re-emergent Calgary Neo-Nazi movement. And indeed it IS on the ascendant again, as the Calgary Sun points out:

Whether we like it or not, the white supremacist movement in the city is growing and scoring points in its quest to spread a message of hate across Calgary.

And as the folks at Stormfront confirm (warning! link leads to nasty website!):

Keep up the good work lads, we're making headway in Calgary! I'd also like to say just how much this Bonnie Collins woman agitates me.

Meanwhile, a few of the speechies seem to be having 2nd thoughts re the tide of old Nazis they have unleashed on Ottawa this Tuesday. Not surprisingly, Ezra is not among them.

PS. Ezra and Mark Steyn et al always argue that the numbers of these Neo-Nazis is so tiny as to be insignificant. Well, this graphic from Stormfront suggests a Canadian membership of about 700. I don't know whether that's significant or not.

Your Daily Nazi, Saturday Edition

In which Macleans columnist Mark Steyn waxes enthusiastic over Barb Kulaszka, Nazi Mark Lemire's lawyer and author (or editor, depending on the attribution) of "Did Six Million Really Die? Report of the Evidence in the Canadian 'False News' Trial of Ernst Zündel".

Macleans must be so proud of their boy.

I've thought of organizing an anti-Macleans boycott, but where do you find copies these days other than the lobby of your local dentist's office? And how do you suppress the circulation of a magazine that is already only associated in people's minds with the sound of a dental drill?

Rogers IP Addresses, Circa 2003

The blogging nerdosphere is atremble with anticipation at the thought of an upcoming confrontation between Richard Warman and the CHRC vs. Macleans Magazine, Mark Steyn, and the Nazis, which will take place in an Ottawa courtroom on March 25th. Some of the folks at FreeD are positively giddy at the thought of crashing the proceedings, breaking the camera ban (if one is in place), and blasting images of CHRC investigators all over the Internet:

They should go for the lifting of the camera ban, and if that is refused, video it in secret and post the proceedings everywhere possible all over the world. Let the whole world see what a Fascist State Canada has become.

Meanwhile, online investigator extraordinaire "Buckets" has been quietly chipping away at an answer to the most interesting question that will be raised during the course of this hearing: did Richard Warman post racist remarks using the pseud "90sAREover" to Freedomsite (a Nazi forum) in 2003?

There is more detail in my previous posts on the topic, but in short: the claim that Warman did make such a posting is based entirely on the fact that, later in 2003, he messaged Freedomsite under the name of Lucy from the same Rogers IP address (66.185.84.204) previously assigned to 90sAREover.

And, in short, Bucket's research challenges the reasoning behind this claim (which is, essentially, that once you get a Rogers address assigned to you, you are stuck with it for months or years at a time).

Bucket's rather ingenious method was to, painstakingly and at length, examine wikipedia edits (and other sources) from the time-period in question looking for this particular IP address, and other Rogers IP addresses, and track what happened to them, sometimes on a minute by minute basis. His general conclusion? They're fluid, baby, real fluid! Anyone assigned the IP in question might also have been assigned one of at least 16 other IP addresses, and anyone assigned one of these other IP addresses might also have been assigned, during their very next on-line session, or even during the course of the same on-line session, the IP 66.185.84.204.

Here's the money quote from his summary thread:

These [IP addresses] reflect, of course, only the tiniest fraction of what was really happening. Every time anyone visits a webpage, the visit is logged somewhere, but very few of those logs are ever published; only a tiny fraction of internet users edit wikipedia, and only a fraction of them do so without signing in, thereby allowing us to see their IPs.

Still, the evidence that we do have makes it is fairly clear that having any one of these IPs--indeed, any Roger IP--at one moment doesn't guarantee that you have it at another. The reason, of course, is that Rogers was using these IPs as proxies for all their traffic from a specific region.

Ezra, You Don't Have to MANUFACTURE Evidence Of Hate Speech At Free Dominion

It happens all the time, as recently as a week ago:

BFA condemns any violence against those of the Moslem faith who mean us no harm. But sadly, it would be foolish for us to allow anyone of the Islamic faith to live in this country. At the very least, our government should deport all foreign Islamic persons immediately as they could pose a greater threat than illegal immigration or even the enemy we fight in Iraq, for some of these Islamists mean us harm while on our own soil.

That's from an article linked to at the site. Some of the responses:

If Muslims had shown up in 2001 from outer space, then we would know exactly what to do, but since they originated here on the earth, technically they are not aliens. This is surely the problem with any argument Ezra Levant and co. make re CHRC investigators and human rights activists like Richard Warman joining forums like StormFront and FreeD just to "plant" evidence of racism and hate speech. The evidence is there already, to be gathered by anyone with eyes to see.

Incidentally, anyone still huffed at my "linking" Ezra to far right militants should note his cute little shout-out to pre-eminent Canadian Nazi Mark Lemire in the post above.

Nope. No Nazis Around Here

City arson detectives are looking into a possible white supremacist link to a pair of firebombings in the city.

"They're getting stronger, they're showing their flags," [said Anti-racism activist Bonnie Collins, who lives in one of the targetted houses] . "There's a lot of kids drawn to it -- they're looking for something and they find acceptance with these groups."

On this particular case the Anti-Racist Canada Blog writes:

While we aren't certain that the firebombing is as a result of Ms. Collins' anti-racist activism, we are probably 99.5% in agreement that this was a legitimate act of intimidation and perhaps attempted murder. At least on[e] Aryan Guard member is closely associated with a neo-Nazi originally from Kitchener, Ontario who is believed to have been involved in some assaults and a firebombing in Edmonton. These two were roommates in Kitchener and moved to Calgary together, however the one eventually returned to Ontario, then moved to Edmonton. It was during his time in Edmonton when the assaults and firebombing took place; similar incidents in Edmonton declined when this individual left the city again. This all speculation, but it's based on some precedent.

For what its worth, the Aryan Guard has denied responsibility on Stormfront.

But, in any case, something to keep in mind when you read one of Jonathon Kay's columns.

Update: The Anti-Racist Canada Blog is fascinating. They report that the Aryan Guard has endorsed the Wildrose Alliance due to their alleged stand against the CHRT/CHRC. However, the Alliance doesn't want their endorsement, and begs to differ:

Further to this, whomever was saying we do not support Human rights commissions is obviously speaking out of turn as there is no such policy and certainly no such prevailing sentiment in the party.

Honestly, you know Ezra's crusade is headed for the tank when he can't even win over Alberta's right-wing fringe.

OTTAWA, February 20, 2008 - The Honourable Rob Nicholson, P.C., Q.C., M.P. for Niagara Falls, Minister of Justice and Attorney General of Canada, today announced the appointment of Edward Peter Lustig as a part-time Board Member of the Canadian Human Rights Tribunal.

Didn't think so. Harper's attempt to reach out to the Canadian center would be good and spoiled were he to get tagged with a label like "the man who freed the Nazis".

On Monday, the National Post posted on its FullComment.com web blog a column by Jonathan Kay that repeated allegations made by Bernard Klatt in a 2006 sworn affidavit against lawyer and Canadian human rights activist Richard Warman. Mr. Klatt has alleged that a racist posting on Freedomsite about Senator Anne Cools was made by Mr. Warman in 2003. The National Post has no evidence to support Mr. Klatt's allegation against Mr. Warman and it hereby retracts any suggestion that Mr. Warman manufactured any statement about Senator Cools. The National Post apologizes for any embarassment this has caused Mr. Warman.

Why, Ezra? Because The Alberta Liberals Are Courting Nutters, The Federal Tories Trying To Avoid Them.

Ezra is wondering why The Alberta Liberal Party is making nice free-speechy noises about him and his AHRC case, even mentioning him "by name", while the Federal Tories are issuing "empty banalities".

That's because, Ezra, the Alberta Liberal Party couldn't draw flies to a pile of dog poop. They'll take your vote, his vote, any vote, and worry about the consequences later. Whereas Mr. Harper's Federal Tories have made a few tentative stabs at reaching out to Canada's various ethnic communities. They see you and an election coming at the same time, and have stomach spasms.

For them, Ezra Levant at the head of a passel of Neo Nazis and people who employ their Freedom of Speech to crack wise about the holocaust is just too much a blast from the Reform Party past, a return to the bad old days when white extremists and Western Seperatists were in, and the Charter of Rights and the Metric system on their way out.

They're not gonna touch you guys with a ten foot pole, Ezra.

Its Not A Nazi Comparison, Rob, It's Real Nazis

Nobody is comparing anyone to Nazis, Mr. Breckinridge. We are just pointing out that real honest to gawd Nazis support Liberal MP Keith Martin's motion to delete Section 13 from the Canadian Civil Rights Act. Mark Lemire is one such Nazi. Paul Fromm is another.

And I hear rumors that Nazi Overlord Ed Zundel will be doing up a news release before the end of the week.

Now, why do the Nazis support M-446? That Nazis are free speech absolutists is laughable. Rather, this portion of of the Act was specifically designed for and has been used extensively to chase down Canadian Nazis. Delete it and, whatever else you do, you will make life easier for Canadian Nazis. You will make it easier for them to communicate, easier for them to recruit. That's why they're behind it, and the whole free speech thing is a feint to sucker the stupid.

So, as a corollary, I would argue for example that people like Mr. Martin and you yourself are not Nazi sympathizers. You've just been conned by Nazis. Booby boy.

And the result of repealing this provision will surely be...more Nazis! and more empowered Nazis! Nazis here, and Nazis there, feeling their oats and living Large!

Real Nazis too, not metaphoric in the slightest. You might be willing to allow that in order to have Ezra Levant quit his whining, I am not.
